1. Agreement to terms
By accessing energyx-channel.digital, requesting information, or purchasing planning programs described on this site, you agree to these General Terms. If you disagree, discontinue use of the site and do not submit inquiries. These terms apply to visitors and to business customers engaging Energyx Channel for operational planning services.
2. Services description
Energyx Channel provides operational planning documentation for POSM allocation, refresh cycles, and outlet visibility. Deliverables are advisory templates, workshops, and written plans unless a separate written statement of work specifies otherwise. We do not operate retail locations, print production, or logistics execution on your behalf unless explicitly contracted.
3. Client responsibilities
You supply accurate outlet lists, permissions for photography, distributor contacts, and timely feedback. You remain responsible for aligning in-store materials with applicable laws. You confirm that POSM artwork is approved for its intended environment before we sequence movement plans.
4. Intellectual property
Site content, templates, and methodologies remain the property of Energyx Channel or its licensors. You receive a non-exclusive license to use deliverables for internal operational purposes related to the contracted scope. You may not resell templates as standalone products without written consent.
5. Liability limits
To the fullest extent permitted under Thai law, Energyx Channel is not liable for indirect, incidental, or consequential losses arising from use of the site or deliverables, including lost profits, missed campaign dates caused by third parties, or inventory write-offs. Aggregate liability for any claim relating to a paid engagement is limited to the fees paid for that specific engagement in the twelve months preceding the claim.
6. Governing law and disputes
These terms are governed by the laws of Thailand. Parties agree to seek good-faith resolution through correspondence and video conference before initiating formal proceedings. Courts located in Thailand shall have exclusive jurisdiction, subject to mandatory consumer protections that cannot be waived.
7. Termination and suspension
We may suspend site access for maintenance, security incidents, or misuse. Either party may terminate an engagement according to the refund and cancellation terms in the Returns & Refunds policy and any statement of work. Termination does not remove obligations to pay for completed work or to respect confidentiality of shared data.
8. Changes to these terms
We may update these General Terms to reflect operational or legal changes. Material updates will be posted with a revised “Last updated” date. Continued use of the site after updates constitutes acceptance unless applicable law requires explicit consent.
